Field tests and breathalyzers are not always accurate. Sleep deprivation and some medical conditions may affect the results. We look at all the tests in combination to determine if there was probable cause for the charge. If the tests were not performed properly, we strive to have them thrown out of court.
The horizontal gaze nystagmus test - or HGN test - is one of the most accurate field sobriety tests when conducted properly, but it is rarely conducted properly. The results of this test are not permitted in Kansas courts to prove DUI.
- Reviewing police videotapes
Police officers often get into habits when filling out their reports. They may automatically check certain boxes - such as slurred speech and bloodshot eyes - without actually observing these signs. Our DUI attorneys will review the police video for inconsistencies between the report and actual events. - Disputing breath test results
Slamming a drink right before you drive causes breath tests to reveal a higher blood alcohol content (BAC). If your BAC was just over the legal limit, we may send you to a doctor or dentist to determine if the alcohol in your breath was higher than in your blood.
